Topical issues of patients’ rights protection in cross-border healthcare in the aspect of directive 2011/24/EU

Objective the present study is carried out to analyse the provisions of the European Council and Parliament Directive 201124EU on the patients39 rights protection in crossborder healthcare the doctrine and practice of the European Court in this area for future comparative legal analysis of the legislation of the European Union EU on the rights protection of crossborder patients with the legislation of the Union state Russia and Belarus as well as the Eurasian Economic Union. Methods general and specific scientific methods of research were used including systematic and structured problemtheoretical formallegal logical methods etc. Results the provisions of the Directive 201124EU were analyzed regarding the rights of patients who use health services or receive medical emergency aid on the territory of another member state of the EU the doctrine and practice of the European Court in the field of crossborder healthcare were studied and analyzed. Scientific novelty for the first time the analysis of the Directive 201124EU was carried out which synthesized the recent practice of the European Court in the field of crossborder healthcare establishing new regulations to ensure high quality and efficient health service in the territory of another member state of the EU the assumptions were studied and analyzed that have been the reasons fro codification of patients39 rights at the supranational level. Practical significance the researched provisions could be used in law enforcement scientific and legislative practice in the implementation of patients39 rights in crossborder aspect of the Union states of the Russian Federation and the Republic of Belarus and with the deepening of the Eurasian integration ndash by the Eurasian Economic Union. nbsp
