Fray Antón de Montesinos: su narrativa y los derechos de los pueblos indígenas en las constituciones de Nuestra América

This essay makes a follow-up to the sermon I am a voice cryingin the wilderness by Fray Anton de Montesinos, that reflectedthe thinking of the small Dominican community settledon the island La Española. The work is developed based on thehistorical context in which the sermon was declared and, accordingto experts, it coincides with the birth of human rightsin our America and the New Laws of the Indies, in which,for the first time, the Spanish Crown censored and punishedabuse, death and enslavement of the Indians. We proceed toshow how these ideals of freedom have also been developedby universities and convents in America, within the UnitedNations and the Universal Declaration of the Rights of IndigenousPeoples, which in turn have resulted as a product of theneoconstitutionalism by the Latin American legislation, likein the Constitutions of Colombia, Ecuador and Bolivia. Thisarticle shows how the friar’s complaint should be extended toall human beings who suffer from violence, famine, enslavement,torture and death, that is, to all those who suffer fromhuman rights violation.
