This article aims to examine the process of laicization of the State and the implementation of that principle in the public education in Brazil, and elaborate the key concept ‘laicity’. It is important to address the issue because it is frequent to see that the degree of laicization of the State, in particular, the non-participation of the Catholic Church in public education as one of the goals of modernity in Brazil. Furthermore, the concept of laic State is being explored and used with more frequency and by minority groups in more and more diversified terms.
